Objectives:

To equip course participants with enhanced competencies to:
1. Understand the legal requirements for a lawful and valid administrative investigation and commissions of inquiry; 2. Appreciate the difference between inquisitorial justice and adversarial justice and requirements of administrative investigations and commissions of inquiry in this regard; 3. Distinguish between ordinary investigations and forensic investigations and discern situations, such as corruption, fraud, ethics and other conduct failure investigations when forensic investigation methods must be applied; 4. Conduct administrative investigations and commissions of inquiry in a manner that optimises outcomes acceptance while minimising the risk of successful judicial reviews; 5. Write Investigative and commission of Inquiry Reports that are clear, concise, accurate, professional and persuasive; 6. Command adequate understanding of the PAJA and related administrative law jurisprudence principles as emerging from applicable court jurisprudence and incorporate these in investigative and Commission of Inquiry processes to minimise successful review risks; and 7. Manage post investigation administration and stakeholder communication in a manner that optimises compliance while minimising case hardening.
